Consultation on the Draft Law on Data Protection

On Wednesday 23rd July 2025, the EuroCham Digital & Committee Vice-Chairperson Mr. Sébastien Ung attend the consultative workshop on Draft Law on Personal Data Protection, organized by the Ministry of Post & Telecommunications.

H.E. KONG Phallack, Secretary of State of MPTC provided an detailed overview of the law’s structure, purpose, and guiding principles—underscoring its alignment with international standards while remaining contextually adapted to Cambodia’s legal, economic, and digital realities. He elaborated on key definitions, rights of data subjects, compliance mechanisms, and the importance of multi-stakeholder cooperation in enforcement and awareness.

As part of this review process, we also examined the key differences between the November 2024 draft and the June 2025 final draft, including:

  • A shift in the regulatory authority from an autonomous agency to the Ministry of Post and Telecommunications (MPTC);
  • Enhanced clarity and protections for data subjects, including expanded definitions and procedural rights;
  • Introduction of internal regulations and sector-specific guidelines to ensure organizational accountability;
  • Clearer conditions for cross-border data transfers and explicit references to the best interests of children;
  • A broadened purpose for the law, linking it to Cambodia’s ambitions in investment, international trade, and digital innovation.
